To ensure that this property, known as premarital property, is distributed fairly on divorce, the couple can draw up either a prenuptial or premarital agreement before the marriage takes place, or a post-marital agreement during their marriage.

The process involves both parties fully disclosing any assets or debts that they have, or had prior to the marriage, including their financial accounts, real estate, and personal items. The marriage agreement can make provision for all of these things, as well as income and expenses before or during the marriage, and inheritance in the event of the death of either spouse.
